This statement describes how Fedasil processes personal data in connection with the use of the website fedasilinfo.be, for which Fedasil acts as the data controller.

Fedasil processes your personal data in accordance with the General Data Protection Regulation, abbreviated as “GDPR”, and the Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data.

The purpose of this privacy statement is to provide greater transparency about which of your personal data is processed, for what purpose, and what your rights are.

Fedasil, the Federal Agency for the Reception of Asylum Seekers (Kartuizersstraat 21, 1030 Brussels), represented by the Director-General, is the data controller responsible for the processing of personal data carried out in connection with the website www.fedasilinfo.be

Why does Fedasil process your data?

Use of personal data via the contact form and email

When you provide personal data to Fedasil via the contact form on our website or by email (such as your name, email address and telephone number), we use this data solely to handle and respond to your question. We rely on your consent for this processing.

Security logs

In addition, we record IP logs of website visitors to protect our website, including against DDoS attacks and hacking attempts. This processing is carried out on the basis of the legal obligation incumbent on Fedasil regarding cybersecurity.

Data in the chatbot

If you accidentally enter personal data into the chatbot on our website, this data will be retained for six months to improve the chatbot’s performance and thus contribute to our mission of providing accurate information regarding the asylum procedure and material help. We process this data on the legal basis of a task carried out in the public interest, which forms part of Fedasil’s mission.

How is your data secured?

Fedasil takes appropriate technical and organisational security measures to protect personal data against accidental or unlawful destruction, accidental loss, unauthorised alteration, unauthorised disclosure or access, misuse and any other unlawful form of processing of the personal data in our possession. 

Who are the recipients of your data?

Your data will not be transferred to third countries or international organisations.

The processing of personal data is carried out by Fedasil staff. Staff members are subject to the official duty of confidentiality as set out in Fedasil’s code of ethics. Some staff, such as doctors, are also bound by professional secrecy. We do everything we can to provide our staff with ongoing training on the importance of privacy and data protection. 

Fedasil staff use automated information systems purchased from external service providers.

In addition to IT services, Fedasil also engages various other processors in the context of human resources management, legal assistance and related support services. These external parties act exclusively on behalf of and under the authority of Fedasil, in accordance with the data processing agreements and the applicable legislation on the protection of personal data.

How long do we retain your personal data?

Fedasil retains personal data in accordance with the legal retention periods and internal archiving schedules. Personal data is not retained for longer than necessary. Once these periods have expired, the personal data is destroyed.

Your rights

Depending on the processing and the legal basis, you have a number of options to retain control over your personal data:

Right of access and copy: You have the right to access your personal data processed by Fedasil and to obtain a free copy of it.

Right to rectification: You have the right to have any inaccurate personal data relating to you corrected as soon as possible. Subject to the purposes of the processing, you have the right to have incomplete personal data completed.

Right to object: In certain circumstances, you have the right at any time to object, on grounds relating to your particular situation, to the processing of personal data concerning you.

Right to restriction of processing: In certain circumstances, you have the right to obtain the restriction of the processing of your personal data.

Right to erasure: In certain circumstances, you have the right to have your personal data erased without undue delay.

Right to data portability: In certain cases, you have the right to receive the personal data you have provided to Fedasil in a structured, commonly used and machine-readable format, and the right to transmit that data to another controller.

Right to withdraw your consent: Where the processing of personal data is based on your consent, you may withdraw that consent.

We remind you that your identity must be reasonably verifiable so that we can be certain that no one else is attempting to exercise your rights.

Your request will normally be processed within one month. If your request is complex or we have a large number of requests to process, this period may be extended by two months.

Automated decision-making

Neither this website nor the chatbot provided on this website uses automated decision-making. The chatbot does not have access to personal files and formulates its responses solely on the basis of the content of this website.
